New Research Identifies Which Retirement Firm Web Sites Are Making Retirement Planning and Saving Easier.

New York, NY (PRWEB) July 12, 2006 -- Most Americans are woefully behind on their retirement savings. In theory, the web should offer some hope. The web should allow people to become better informed about retirement planning. The web should make it easy to get started with the right kind of retirement account, thus making saving easier. For people that make it to the retirement section of the site, about half of the sites do not provide the most basic information about retirement fundamentals, such as finding clear, easy to read definitions of account types, or getting a clear definition of "tax deferral".

What about Full Service?

Most full service brokerages, while sometimes providing helpful content, make it extremely difficult to set up an account, forcing people who may just want to roll over funds to request a printed form, fill it out and fax it back. Most banks don't do much better.

"Most sites are either cluttered up with too much content that's not written for the web, or too Spartan to be of any use," said Steve Ellis, a Change Sciences partner. "For brokerages, full service or discount, not having a meaningful retirement web strategy simply turns away a wide range of prospects."

Think about it, if you can't make a cell phone payment on time, what are the chances of making your mortage payment on time?

2.  Don't carry a high balance to available credit. It is very bad looking if you carry high balances on your credit cards or other debts. Assume you have a credit card with a maximum credit limit of $3,000. However, if you are showing a monthly balance of $2,800, then this will hurt your credit worthiness. VA mortgage companies want to see that you have been granted credit by others, because this shows you are capable of borrowing money and paying it back, however if you are always carrying around a large balance then you appear to live to the maximum and thus again you are labeled a bit more risky.

3.  Don't close your credit cards/lines. A very misunderstood fact about loans in general is that a home owner will appear better if they pay off all their debts prior to applying for a VA mortgage. This is completely untrue. Banks/lenders want to see that you are able to receive credit from others and that you can control that credit. If you close all your accounts it appears as though something bad has happened and you had to get rid of all your debt. This act alone can greatly damage your credit. Use your credit cards, but use them wisely. It is recommended to charge them up a little then to pay them off each month.

4.  Keep a stable job. It is very important that you are not jumping from job to job especially if your jobs have nothing in common. I basic principle in getting into a VA mortgage is to prove to the Lender that you are not RISKY and if you are going from car mechanic to insurance agent, then you appear as though you are still not sure about your career choice and essentially make yourself appear as a risk.

5.  Apply early for your Certificate of Eligibility (COE). You can download the form right from our website by going to our links section. If you are already working with a preferred VA mortgage company assigned to you by LowVARates then there is a chance they have ordered you one offline via ACE. It is imprtant to understand that even if you are approved for a VA loan, that without your COE form you cannot get a VA loan. Leite’s Culinaria began in 1999, a time when the Internet had few quality food sites. Leite, a freelance food writer, wanted to create a cyber-portfolio that editors could visit in order to read his work. In no time, he began receiving e-mails from readers who found their way to the site based upon its content, which, at the time, dealt mostly with Portuguese cooking.

“Frankly, I was shocked when people found me,” says Leite of those early years. “I had no idea that search engines spidered Web sites. I was planning to using it as a destination for editors, not for the general public.” Within the year, Leite added other content, including recipes, resources, and columns. In 2000, Gary Allen, author of the "Resource Guide for Food Writers" (Routledge, 1999) and the upcoming "The Herbalist in the Kitchen" (University of Illinois Press) was tapped as food history editor.

Avery joined the site in 2003 as one of a dozen recipe testers. She quickly became recipe-testing coordinator and grew the section to almost 200 members. In 2004, she became food editor, and her responsibilities increased to include planning each month’s issue with Leite as well as determining which books and recipes to highlight.

Leite writes for the site and edits the work of contributing writers, a group which now encompasses established and up-and-coming writers. The combination of editors, writers, and the site’s various offerings attracts approximately 1.3 million readers a year. To encourage new writers, Leite established The Leite's Culinaria Scholarship for Narrative Food Writing to the Symposium for Professional Food Writers at The Greenbrier in White Sulphur Springs, WV. The first winner was Ana Schwartzman, whose work will appear on the site later in the year.

He likewise advised, “Even though the law governing digital assets is unclear, largely because it hasn’t yet been written, there are ways to protect those assets and make sure your heirs are able to locate and use them.”

“First, keep a master list of all your online dealings, complete with urls, user names and passwords,” Hudkins said. “The list should include items like domain names, where they are registered, and when they need to be renewed to keep the business name and Internet location. Put this particular information on paper, update it every time something new is added or something old deleted, and keep it in a safe place with your other important business papers, preferably in a safety container.”

Hudkins also advised, “Make sure your attorney or your estate executor is aware of the list, even if you don’t want it opened until after your death. Instruct your executor or attorney as to when the list is to become available to your heirs – for example in the case of serious illness in the event that someone needs to take care of online business transactions in your stead. Such instructions may or may not be legally binding, but chances are your instructions will be followed, as a matter of moral obligation.”

“If you have a prosperous online business, online bank accounts, e-trade accounts, or other valuable digital assets, those need to be figured into your estate planning,” Hudkins said. “Otherwise, your heirs may be stuck with a messy situation and many unexpected expenses, or even legal challenges to deal with – problems that your estate planning was initially designed to protect against.”

Florida Litigation Attorney Don Conwell Successfully Defends Hooters Rival Ker’s Winghouse in Lawsuit Appeal filed by the Hooters Restaurant Chain.

Tampa, Florida (PRWEB) June 20, 2006 -- Ker’s Winghouse, a fast growing restaurant chain founded by former NFL Dallas Cowboys football star, Crawford Ker, defeated Hooters’ trade dress infringement lawsuit appeal last week, winning more than one million dollars in counterclaim damages against the prominent restaurant chain (In the United States Court of Appeals for the Eleventh Circuit D.C Docket Number: 03-00116-CV-ORL-22-JGG).

Hooters’ appeal repeated allegations made by Hooters in its failed lawsuit against Ker’s Winghouse in the United States District Court that Ker’s Winghouse—whose female wait staff also wear short shorts and tank tops —unfairly copied proprietary elements from the “Hooters Girl” and from Hooters restaurant décor.    

The decision by United States Circuit Court Judge Rosemary Barkett rejected Hooters’ appeal, stating “Hooters’ trade dress infringement and dilution claims fail as a matter of law.”

Ker’s Winghouse was represented in both the trial and appellate courts by Florida litigation lawyer Don Conwell of Conwell, Sukhia and Kirkpatrick, which partnered with the Tampa based law firm of Fowler White Boggs Banker to successfully defend Ker’s Winghouse.     The appellate court’s written opinion affirming the judgment for Ker’s Winghouse in the trial court came quickly, only seven days after Conwell argued the appeal before the appellate court panel of judges.

“This is a great day for our client, which can now continue its head to head competition with Hooters in the market place, free of the threat of oppressive litigation,” said attorney for Ker’s Winghouse, Don Conwell.

The litigation by Hooters against Ker’s Winghouse has been in the courts for several years. The case was tried in federal court in Orlando, Florida in November, 2004. In December, 2004, United States District Court Judge Anne Conway rejected Hooters’ trade dress infringement lawsuit claims and awarded $1.2 million in counterclaim damages to Ker’s Winghouse on a jury verdict in favor of Ker. Judge Conway adopted the arguments of Florida attorney Don Conwell that Hooters did not have protectable trade dress and that the trade dress of Ker’s Winghouse was not likely to confuse consumers.

After that verdict, Conwell stated, “The directed verdict and jury award completely vindicate Winghouse’s position that Hooters was using its wealth and muscle in the courts to try to unfairly exclude legitimate competition.”

The lawsuit has been considered a significant case in intellectual property litigation and has received national televised attention with coverage on MSNBC and numerous other local and national press outlets.

PureNight Sleep Air Purifier Created By Halo

 Halo Creates Air-Filtering Device

Halo Innovations Inc., a startup launched to combat sudden infant death syndrome, is using technology developed in that fight to enter the much bigger and more competitive market of air filtration systems. Halo recently introduced its first product for that space: PureNight, a filtration unit that it claims can remove nearly all allergens from the air surrounding a bed.

It's a big step for Halo, which generates most of its $5 million in revenue from a sleeping-bag-like sack designed to keep infants warm without the risks of suffocation that standard blankets can cause. The consumer air-filtration market, in contrast, is estimated at nearly $400 million, with big brand names such as Honeywell and the Sharper Image.

But Halo has recruited an executive who knows the nighttime: Chuck Dorsey, a former executive with Plymouth-based Select Comfort Corp. who plans to use some of the direct-marketing strategies employed by the air-mattress maker. Print ads began this fall, and informational TV spots will start airing in early 2006. Halo also is closing on $2 million in funding to help the rollout.

The SleepSack was Halo's first and best-known item. But the technology behind the PureNight filtration system came from a later product, a crib mattress with a built-in ventilation system that kept carbon dioxide from pooling around an infant's head.

Executives recognized that the filtration systems in the mattress could have a broader market potential. More than 50 million people suffer from allergies or asthma attacks, which can often strike at night. Halo has conducted a clinical study of the $499 PureNight device, which resembles a large desk lamp that hangs over the user's bed. Allergy sufferers in the study reported immediate improvement, Dorsey said. "For a good number of people, we're a solution that hasn't existed before," he said.

Which is not to say that Halo is going into an untapped market: The competition is fierce and well-established. At $400, Sharper Image's Ionic Breeze filtration system is the retailer's best-selling item, even though Consumer Reports has criticized the machine as ineffective. Dorsey said a second study, conducted at the University of Minnesota, found the Sharper Image product cleaned about 27 percent of pollutants from the air overnight; Halo's performance: 99 percent.

Those figures will be front and center of Halo's marketing campaign, portions of which can be found at www.purenight.com. The company isn't using an outside ad agency, relying instead on the infomercial-style ads and direct marketing Dorsey used at Select Comfort in the 1990s. "This product works, but it's a high-ticket item and we've got no market awareness," Dorsey said. Consumers are going to need a lot of information about it to convince them to buy, and sales will take longer than a retail environment would allow.
